Why Gender Identity is Unconstitutional

The Biden administration is attempting to force the broad acceptance of Transgender ideology, on the most innocent and impressionable population – children. The Biden administration to trying to do this, by adding ‘gender identity’ to the language of Title IX. Not only does this violate the original meaning and intent of the law, it forces Americans to accept an objectionable belief system, which is a clear violation of the 1st Amendment.

The following is Wikipedia’s definition of gender identity:

‘Gender identity is the personal sense of one's own gender. Gender identity can correlate with a person's assigned sex or can differ from it. In most individuals, the various biological determinants of sex are congruent, and consistent with the individual's gender identity. Gender expression typically reflects a person's gender identity, but this is not always the case. While a person may express behaviors, attitudes, and appearances consistent with a particular gender role, such expression may not necessarily reflect their gender identity. The term gender identity was coined by psychiatry professor Robert J. Stoller in 1964 and popularized by the controversial[why?] psychologist John Money.’

From above, you can see that gender identity is a belief system: it is not a system that is based on facts or objective truth. The following are other important points about gender identity:

  1. It offers no objective proof of its claim.
  2. It flies in the face of the universally held notion of gender and sex being consistently aligned with one another, which mankind has had since the dawn of civilization.
  3. Choosing Gender Identity hypothesis over conventional notions of gender, violates Occam's razor, as you are choosing a convoluted notion of gender that is consistent with the thinking of someone who is mentally ill, over a simpler notion, that has been proven over time to practically work. (In other words, the conventional notion of gender has been found over millennia to be objectively true, while gender identity is a highly subjective and unproven hypothesis.)

Gender identity is therefore more akin to a religion than to scientific fact. Now given that the government is prohibited from establishing a religion (or forcing people to adhere to a belief system or way of thinking), requiring the recognition of and adherence to gender identity hypothesis, is unconstitutional - as it violates the 1st Amendment. Therefore the Biden Administration amending Title iX, requiring people to adhere to gender identity hypothesis, is unconditional. Further, state laws like in California, that require citizens embrace and adhere to gender identity hypothesis, are also unconstitutional. These states cannot force their citizens to think and act according to a belief system.
